Fierce Links Enterprise Terms and Services
This document (the "Agreement") serves as the agreement between [Customer Name] (referred to as "Customer" or "you") and Fierce Technologies Corporation ("Fierce Technologies" or "we" or "us") for the use of the Fierce Links Enterprise Services ("Enterprise Services").
1. Acceptance of Terms
This section states that by accessing and using the Fierce Links Enterprise Services, you acknowledge and agree to be bound by the terms and conditions outlined in the Agreement. If you are agreeing on behalf of an organization, you are confirming that you have the authority to bind that organization to this Agreement.
2. Scope of Enterprise Services
Fierce Links Enterprise Services encompass a range of URL management and analytics tools provided by Fierce Technologies. These include URL shortening, link customization, advanced analytics, and other related features (collectively referred to as the "Enterprise Services"). These services are designed for business and professional use only and are subject to the terms and conditions set forth in this Agreement.
3. Authorized Users
As a Customer, you are granted the right to designate specific individuals as Authorized Users to access and utilize the Enterprise Services on your behalf. You are responsible for ensuring that your Authorized Users comply with this Agreement, and you understand that any breach of this Agreement by an Authorized User will be deemed a breach by you.
4. Fees and Billing
The Enterprise Services may be subject to applicable fees, as outlined in the pricing plan or agreement agreed upon between you and Fierce Technologies. By using the Enterprise Services, you agree to pay the fees associated with the selected plan or agreement in a timely and appropriate manner.
5. Intellectual Property Rights
Fierce Technologies asserts that it retains all ownership rights and intellectual property rights associated with the Enterprise Services. This includes trademarks, copyrights, and proprietary technology. The Agreement makes it clear that you do not acquire any ownership rights or licenses beyond the limited right to use the Enterprise Services as specified within the Agreement. Respect for Fierce Technologies' intellectual property is vital in maintaining a fair and legal usage of the services
6. Data Privacy and Security
Fierce Technologies values your privacy and is committed to ensuring the security and protection of your data. The collection, storage, and processing of any personal or business-related information provided by you or collected through the use of the Enterprise Services will be governed by Fierce Technologies' Privacy Policy. By using the Enterprise Services, you expressly consent to the treatment of your data as described in the Privacy Policy.
7. Term and Termination
This Agreement shall commence upon your acceptance and continue for the agreed-upon subscription term, unless terminated earlier as provided herein. Either party may terminate this Agreement with written notice to the other party. Upon termination, you shall cease all access and use of the Enterprise Services, and Fierce Technologies shall have no further obligations to you.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Fierce Technologies shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or relating to the use of the Enterprise Services. This includes any loss of data, interruption of business operations, or any damages resulting from the use or inability to use the services, regardless of whether Fierce Technologies has been advised of the possibility of such damages.
9. Governing Law and Dispute Resolution
This Agreement shall be governed by and interpreted in accordance with the laws of the jurisdiction in which Fierce Technologies is headquartered. Any disputes arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
10. Entire Agreement
This Agreement represents the entire understanding and agreement between you and Fierce Technologies concerning the Enterprise Services and supersedes any prior or contemporaneous communications, representations, or agreements, whether written or oral, regarding the subject matter herein.
By using the Fierce Links Enterprise Services, you acknowledge and agree to be bound by the terms and conditions set forth in this Agreement.
